Terms of Service

These Terms of Service ("Terms") govern your access to and use of Flickcast (the "Service"), a social media content resizing, AI captioning, and multi-platform scheduling/publishing tool, operated by Nukhba Al Zawiya Technologies L.L.C ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

  • "Service" — the Flickcast platform, including the website, application, and all features described herein.
  • "User" / "Customer" — the natural or legal person that registers for and uses the Service.
  • "User Content" — any video, image, text, caption, or other material a User uploads, generates, or configures through the Service.
  • "Connected Account" — a third-party social media account (e.g., Instagram, TikTok) a User authorizes Flickcast to publish to via our publishing service.
  • "Brand" — a workspace within a User's account representing one client or entity, with its own media, voice, and Connected Accounts.
  • "Team User" — a User on a plan that includes team seats, managing multiple Brands and/or team members with role-based access.
  • "Sub-processor" — a third-party service provider we use to deliver the Service (e.g., our media service, Anthropic, our publishing service, Resend, Base44), acting on our behalf.

3. Description of the Service

Flickcast allows you to upload a single video or image, automatically resize it for multiple social media platforms, generate bilingual (English/Arabic) AI-assisted captions, and publish or schedule the resulting posts across your connected social media accounts.

Flickcast relies on the following Sub-processors to operate:

  • Media service — media storage, hosting, and resizing
  • Anthropic (Claude API) — AI-generated caption suggestions
  • Publishing service — social media publishing, scheduling, and platform OAuth connections
  • Resend — transactional and account-related email delivery
  • Base44 — application hosting, database, and authentication infrastructure

Where a Sub-processor is identified by function rather than by name above, it is named under a confidentiality obligation. A current list of all Sub-processors, including those identified by function, is available on request at privacy@flickcast.app.

Your use of the Service is also subject to the terms of service of any third-party social media platform you connect (e.g., Instagram, TikTok, Facebook). We are not responsible for the policies, availability, or actions of these third-party platforms.

4. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the authority to enter into these Terms on behalf of yourself or the entity you represent, to use the Service.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information and promptly update it if it changes. We may suspend or terminate accounts that provide false information or are used in violation of these Terms.

If you connect social media accounts (via our publishing service) or invite team members (on plans that include team seats), you are responsible for ensuring you have the authority to do so and that all members comply with these Terms.

5.1 Team Accounts & Roles

Team Users may invite team members to a Brand with defined roles (e.g., member, approver, owner). The Brand owner is responsible for all actions taken by invited members within that Brand, including content approved or published on the owner's behalf. Where Flickcast's approval workflow is used, a post marked "approved" is treated as authorized for publishing by whoever approved it.

6. Subscription Plans, Billing & Cancellation

6.1 Plans

Flickcast is offered under multiple tiers: Free, Creator ($12/month), and Studio ($29/month). Paid tiers include a set number of connected social accounts; additional connected accounts may be added for $4/month each. Plans previously offered at other prices remain in effect for Users subscribed to them until changed or cancelled. Current plan details and pricing are available in-app and are subject to change with notice.

6.2 Billing

Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated at purchase) via our payment processor. By subscribing, you authorize recurring charges to your chosen payment method until you cancel.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.

6.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date. We do not provide prorated refunds for partial billing periods except as required by law or expressly stated at time of purchase.

6.5 Failed Payments

If a payment fails, we will attempt to notify you and retry the charge. Continued failure to pay may result in suspension of publishing and scheduling functionality, and eventual downgrade or suspension of your account.

6.6 Price Changes

We may change subscription pricing with reasonable advance notice. Continued use of a paid plan after a price change takes effect constitutes acceptance of the new price.

7. Your Content

7.1 Ownership

You retain all ownership rights to the video, image, and text content you upload to Flickcast ("User Content"). We do not claim ownership over your User Content.

7.2 License to Us

By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, modify (for format/aspect-ratio purposes only), and transmit your User Content solely as necessary to provide the Service — including transmitting it to our media service for processing and storage, to the Claude API for caption generation, and to our publishing service and connected social platforms for publishing.

7.3 Your Responsibility

You are solely responsible for your User Content and for ensuring you have all necessary rights, licenses, and permissions to upload, resize, caption, and publish it. You represent that your User Content does not infringe any third party's intellectual property, privacy, or other rights, and does not violate any applicable law or the terms of any connected social media platform.

8. AI-Generated Captions

Flickcast uses the Claude API to generate suggested captions and hashtags in English and Arabic. AI-generated content is a suggestion only. You are solely responsible for reviewing, editing, and approving any caption before it is published or scheduled. We do not guarantee the accuracy, appropriateness, cultural sensitivity, or platform-compliance of AI-generated captions, and we are not liable for consequences arising from captions you choose to publish without adequate review.

No training on your content. We do not permit our AI Sub-processors to use your User Content or prompts to train their underlying models. Content sent to the Claude API is processed solely to generate your caption suggestions.

9. Acceptable Use & Fair Use Policy

You agree not to use the Service to:

  • Upload, publish, or schedule content that is illegal, infringing, defamatory, obscene, hateful, or that violates the rights of any third party;
  • Circumvent, disable, or interfere with the security or proper functioning of the Service;
  • Use the Service to spam, mislead, or deceive audiences on connected platforms;
  • Violate the terms of service or community guidelines of any connected third-party platform (Instagram, TikTok, Meta, etc.);
  • Reverse-engineer, resell, sublicense, or white-label the Service without our written permission;
  • Use the Service in a manner that exceeds the usage limits of your subscription tier.

Fair Use Policy. Because publishing volume drives our own third-party costs (e.g., per-connected-account fees), each plan tier is subject to a fair and reasonable posting volume consistent with normal use for its stated limits. Abnormal or automated bulk-posting behavior inconsistent with a plan's intended use may result in a manual review, a temporary posting hold, or a request to upgrade to a tier suited to that volume. We will make reasonable efforts to notify you before restricting an account under this policy, except where doing so would risk harm to the Service, other users, or connected platforms.

We reserve the right to suspend or terminate accounts that violate this section.

10. Intellectual Property

The Flickcast name, logo, wordmark, design, and underlying software are the property of Nukhba Al Zawiya Technologies L.L.C and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

11. Third-Party Platforms

We integrate with third-party social media platforms via our publishing service. We do not control, and are not responsible for, the availability, policies, API changes, account suspensions, or content moderation decisions of these third-party platforms. If a connected account's authorization expires or is revoked by the platform, scheduled posts may fail until reconnected — this is outside our control, though we will make reasonable efforts to notify you (see Privacy Policy and in-app notifications).

12. Termination

We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a risk to the Service, other users, or third parties. You may terminate your account at any time. Upon termination, your right to use the Service ends immediately; certain provisions of these Terms (ownership, disclaimers, limitation of liability, governing law) survive termination.

13. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy of AI-generated content or the continued availability of any third-party platform integration.

14. Limitation of Liability

To the maximum extent permitted by law, Nukhba Al Zawiya Technologies L.L.C and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising from your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Nukhba Al Zawiya Technologies L.L.C from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any third-party platform's terms of service.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at legal@flickcast.app. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the Emirate of Dubai, United Arab Emirates, unless otherwise required by applicable law.

17. Changes to These Terms

We may update these Terms from time to time. The most current version is always available in the Service. Material changes will be notified via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
